ORDER
This petition has been filed for issuance of Writ of Mandamus, directing the respondents to issue No Objection Certificate in favour for running petitioners PHOENIX UNISEX BEAUTY PARLOR AND WELLNESS SPA at Flat No.171, R.C.C.Building 1st Floor, Pothigai Nagar, Thirunageswaram Post, Thiruvidaimarudhur Taluk, Kumbakonam City, Thanjavur District, by considering petitioner's representation, dated 19.08.2026, within the period that may be stipulated by this Court.
2. Mr.D.Rajaboopathy, learned Government Advocate, (Crl. Side) takes notice for the respondents. Heard the counsel on either side and perused the records.
3. The learned Government Advocate submitted that the petitioner must submit all requisite documents to enable the police to inspect the business premises in light of the applicable Government Orders/Notifications. He further submitted that only upon complete satisfaction regarding compliance, the police will issue the NOC. Additionally, the learned Government Advocate submitted that an NOC can be issued only after the competent authority issues a license to the petitioner.
4. The learned counsel for the petitioner strongly denied the latter part of the Government Advocate’s submission, contending that obtaining an NOC from the police is a prerequisite for applying and availing a license to run the Spa.
5. Recording the aforesaid submissions, the 2nd respondent is directed to consider the petitioner's representation dated 19.08.2026. If any additional documents are required, the 2nd respondent shall issue a formal memo well in advance calling for the same from the petitioner, conduct an inquiry, and inspect the premises if necessary. Upon being satisfied with the parameters specified in the relevant Government Notifications, the 2nd respondent shall issue the NOC.
6. As there is an apprehension raised by the learned Government Advocate that the petitioner might operate the Spa without eventually securing a license, the petitioner is strictly directed to submit a copy of the license to the
2nd respondent for verification immediately upon obtaining it from the competent authority.
7. With the above directions, this Writ Petition stands disposed of. 22.09.2026 TM To
1. The Superintendent of Police, Thanjavur District, Thanjavur.
2. The Inspector Of Police, Thiruvidaimarudhur Police Station (F6), Thiruvidaimarudhur, Thanjavur District.
3. The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai.
