ORDER

Learned counsel for the respondent Mr.V.Manohar brings to my notice that the very same impugned order in EA No.528 of 2020 dated 30.11.2022 was challenged before this Court in CRP No.4349 of 2022 and the said revision came to be dismissed on 25.07.2024. Learned counsel would further state that the dismissal of the revision was also brought to the notice of the Executing Court and subsequently, the Execution Petition has also been terminated.

2. Learned counsel for the petitioner would however state that he has come on change of vakalat and he is not aware of the earlier unsuccessful challenge to the very same order in EA No.528 of 2020.

3. However, the fact remains that by order dated 25.07.2024, this Court dismissed CRP No.4349 of 2022 which was a revision challenging the order passed in EA No.528 of 2020 dated 30.11.2022. The very same order is now under challenge in the present revision petition, that too, with a delay of 1192 days. The affidavit in support of the condone delay application does not even disclose the fact that earlier challenge to the very same impugned order was unsuccessful before this Court in CRP No.4349 of 2022.

4. Hence I do not see any merit or bonafide in the application, seeking condonation of delay and the revision itself is not maintainable in view of the very same order already challenged before this Court unsuccessfully.

5. Accordingly, CMP No.19623 of 2026 is dismissed. Consequently, the civil revision petition is dismissed at the SR stage itself. No costs. 21.09.2026 Index:yes/no Website:yes/no Speaking Order/Non-speaking Order sr To The Subordinate Court, Poonamallee
