O R D E R

(Order of the Court was made by S.M.Subramaniam,J.) The present Review Application has been instituted, seeking review of the order of this Court dated 10.06.2024 passed in W.P.No.24511 of 2018.

2. Review Applicant-in-Person has raised several allegations in conduct of investigation by Deputy Superintendent of Police, Vedaranyam Sub-Division, Nagapattinam District and registering of false cases against him. The matter was heard on several occasions by this

Court and directions were issued to Police Authorities to ensure fair conduct of investigation and prosecute offenders in the manner known to law. Since there is prolongation of litigation as well as criminal cases instituted at the instance of Review Applicant-in-Person, this Court had directed Superintendent of Police, Nagapattinam District, to be present before this Court. Accordingly, Mr.Kelkar Subhramanya Bhalchandra, I.P.S., Superintendent of Police along with Mr.K.Annadurai, Deputy Superintendent of Police is present today.

3. Superintendent of Police has filed an affidavit, stating that final report has already been filed in the criminal cases and all steps are being taken to ensure that trial is conducted in a fair manner.

4. Mr.John Satyan, learned Public Prosecutor appearing for R7 to R9 would submit that cases have been registered against Review Applicant-in-Person also.

5. In reply to the above, Review Applicant-in-Person would state that those cases had been falsely registered against him.

6. May that as it be, Police Authorities are bound to investigate all cases fairly and try cases before the competent Court of

Law by following procedures as contemplated. Superintendent of Police shall issue necessary instructions to Deputy Superintendent of Police to proceed with cases as expeditiously as possible.

7. We have perused the report of Registrar (Judicial), High Court, Madras, which was filed on the basis of directions issued by this Court on 27.08.2026 in respect of criminal cases pending before District Munsif-cum-Judicial Magistrate, Vedaranyam in P.R.C.No.18 of 2023. From the report, we find that cases are prolonged and protracted for long years, thereby depriving Review Applicant-in-Person to have a fair trial. Pertinently, Magistrate concerned has adjourned the matter for one year, which is not normally done. Such adjournments are opposed to speedy and fair trial in criminal cases.

8. Constitutional Courts have time and again reiterated that speedy trial of criminal cases is a fundamental right. That being so, adjourning cases after one year is opposed to criminal law jurisprudence. Unnecessary adjournments are to be avoided by Courts. Rule is to conduct cases and adjournment is an exception. All adjournments are to be granted only if genuine reasons are placed. Adjournments on flimsy grounds can at no circumstances be encouraged by Courts. Courts are expected to dispose of cases within a reasonable period of time, so as to earn trust in the minds of public. Long adjournments will result in frustration to litigants and therefore, Courts at no circumstances grant prolonged adjournments, as given in the present case and to ensure that trial commences at the earliest and is completed within a reasonable period of time.

9. Concerned Trial Court is directed to ensure that criminal cases pending in connection with Review Applicant-in-Person are disposed of as expeditiously as possible. The hearing date fixed by District Munsif-cum-Judicial Magistrate, Vedaranyam shall be advanced and necessary steps may be taken for early committal of cases, so as to ensure speedy trial. Deputy Superintendent of Police, Vedaranyam Sub- Division, Nagapattinam District is directed to furnish a copy of this order to the Trial Court concerned for appropriate action.

10. At this juncture, Review Applicant-in-Person has made a submission that he is under severe threat and persons involved in criminal cases frequently make attempts to attack him.

11. The Superintendent of Police, Nagapattinam District is directed to provide adequate Police protection to Review Applicant-in- Person, whenever required. It is brought to the notice of this Court by learned Public Prosecutor that already sufficient Police protection has been extended to Review Applicant-in-Person. If so, such protection is to continue.

12. With the above observations and directions, the present Review Application is disposed of. No costs. (S.M.S.,J.) (M.S.Q.,J.) 16-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No AR
