Judgment

(Judgment of the Court was delivered by S.M.Subramaniam J.) State preferred the present intra court appeal challenging the interim order dated 03.09.2026 passed in W.P.No.32349 of 2026.

2. The first respondent is an aspirant of medical course. She applied under the Eminent Sports Persons quota, for which 15 seats are allotted (13 seats for MBBS and 2 seats for BDS course). It is not in dispute between the parties that Form-2 is to be complied with as per the prospectus.

3. Learned Additional Advocate General Mr.P.V.Balasubramanian would submit that Form-2 submitted by the respondent was not accompanied by relevant certificate and therefore marks are not awarded, which resulted in denial of MBBS seat under Eminent Sports Persons quota. However, Mr.Karthik Rajan learned counsel for the respondent would submit that Form-2 produced by the respondent would be suffice, which was not considered. It is a disputed fact between the parties.

4. These disputed facts are to be adjudicated on merits before the writ court. Further, it is contended by the learned Additional Advocate General that all the 15 seats were already filled and the candidates selected have joined in the course. Therefore, the grounds raised in the writ petition would not be maintainable. However, these issues are yet to be adjudicated by the writ court and the interim order would not cause any prejudice to the appellants before this Court, since there is no positive direction. The writ Court has only directed the appellants to furnish a report. Since the matter is listed today before the learned Single Judge, the appellants are granted one week time from today to submit the report as directed by the Writ Court, enabling the court to consider the issues on merits.

5. With the above observations, the writ appeal stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.) (K.G.R.,J.) 16-09-2026 Index: Yes Speaking order Neutral Citation: Yes KST
