ORDER

This petition has been filed for issuance of Writ of Mandamus, directing the respondents to grant adequate police permission for conducting the proposed peaceful condemnation protest on 29.09.2026 from 11.00 am to 2.00 pm at near Manila (Moorthy) Tea Shop, opposite to Bose Complex, Yanaimalai, Othakadai, Madurai District,by considering the petitioner's representation dated 18.08.2026.

2. Mr.D.Rajaboopathy, learned Government Advocate, (Crl. Side) takes notice for the respondents. Heard the counsel on either side and perused the records.

3. The learned counsel for the petitioner submitted that the petitioner is the President of the Organization against Injustice (mePjpfs; vjph;g;g[ ,af;fk;). The petitioner has submitted a detailed representation running to nearly four pages dated 18.08.2026, seeking permission to conduct a demonstration against the alleged injustice meted out to various persons, including members of the petitioner organization belonging to the Pudhirai

Vannar community. Since no decision was taken by the respondent police on the said representation, the present petition has been filed on 11.09.2026 and is listed today for admission.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner's representation was considered and that the Inspector of Police, Othakadai Police Station, Madurai District, who is the third respondent herein, rejected the same by order dated 14.09.2026, stating that the purpose of the proposed demonstration was not clear and that the contents of the representation were vague and unclear. It was therefore submitted that, if the petitioner submits a fresh representation, the police would consider the same in accordance with law.

5. During the course of submission, the learned Government Advocate (Crl. Side) further submitted that the police had instructed him to state that the petitioner's representation was not clear, particularly with regard to the proposed demonstration, which, according to the police, appeared to be directed against a particular community, namely, the Scheduled Caste community.

6. On perusal of the representation submitted by the petitioner, this Court finds that there is no such content or allegation against any particular community. Per contra, the petitioner has stated that the organization is seeking to address the grievances and alleged inaction on the part of the Government in respect of various persons and communities, particularly the members of the Pudhirai Vannar community. Therefore, the submission made on behalf of the police that the representation is not clear cannot be accepted.

7. The learned Government Advocate further submitted that, if the petitioner reduces the duration of the proposed demonstration from three hours to two hours, the police would have no objection to granting permission for conducting the demonstration. The said submission is taken on record. The learned counsel for the petitioner also accepted for the same.

8. The petitioner has sought permission for the demonstration on 29.09.2026. The rejection order stating that the petitioner should submit a fresh representation does not arise for consideration, since the earlier representation submitted by the petitioner dated 18.08.2026 contains sufficient particulars regarding the proposed demonstration.

9. Having regard to the above aspects and the materials available on record, this Court issues following directions:

(i) The respondent police is directed to grant permission to the petitioner to conduct the demonstration on 29.09.2026 from 11.00 a.m. to 1.00 p.m., at the place proposed by the petitioner, namely, near Manila (Moorthy) Tea Shop, opposite to Bose Complex, Yanaimalai, Othakadai, Madurai District.

(ii) The petitioner shall conduct the demonstration in a peaceful and proper manner without causing any disturbance to public order and without hurting or offending any community or any person.

(iii) The respondent police shall make necessary arrangements to monitor the demonstration. If any untoward incident takes place or if there is any disruption of law and order, the police are at liberty to proceed further in accordance with law.

(iv) The petitioner shall ensure that the demonstration is confined to the permitted period from 11.00 a.m. to 1.00 p.m. and shall disperse peacefully thereafter.

10. With the above said directions, this writ petition stands disposed of. 16.09.2026 TM

To

1. The Superintendent of Police O/o.The Superintendent of Police Madurai District.

2. The Deputy Superintendent of Police O/o.The Deputy Superintendent of Police Umachikulam Sub Division Madurai District.

3. The Inspector of Police Othakadai Police Station Madurai District.

4. The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai.
