ORDER

This petition has been filed for issuance of Writ of Mandamus, directing the respondents to grant police protection for conducting of Kumbabishekam and Annathanam in the petitioners village on 16.09.2026 and 17.09.2026 by considering the petitioners representation dated 15.09.2026, within the time limit fixed by this Court.

2. Mr.D.Rajaboopathy, learned Government Advocate, (Crl. Side) takes notice for the respondents. Heard the counsel on either side and perused the records.

3. The learned counsel for the petitioner submitted that on midnight of 15.09.2026 at about 02:00 AM, the respondent police visited the petitioner's residence and orally directed them to obtain an appropriate order/permission from the Court to proceed with the Kumbhabhishekam, failing which the event would not be permitted.

4. In view of the urgency, the petitioner moved a Lunch Motion on 15.09.2026. The matter was duly numbered and taken up for consideration.

5. On that day, the learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there is an ongoing dispute between two rival groups/communities in the village, categorized as 'A- Party' (represented by the petitioner) and 'B-Party'. It is submitted that 'B-Party' has raised objections to the conduct of the Kumbhabhishekam, leading to law and order issues in the locality.

6. A perusal of the typed set of papers reveal that representations dated 15.09.2026 was submitted by the petitioner to the respondent police seeking permission and protection. The learned counsel for the petitioner further submitted that already the petitioner sent a written representation on 10.09.2026, but without keeping a copy of the same. Hence, there is no possibility to produce the copy of the same. The learned Government Advocate (Crl. Side) also stated that it is true that the petitioner has given a representation on 10.09.2026, which is pending for consideration.

7. Accordingly, this Writ Petition is disposed of with the following directions:

(i) The 2nd Respondent is directed to consider the petitioner’s representations dated 10.09.2026 and 15.09.2026 on merits, after hearing both 'A-Party' and 'B-

Party' if necessary, and pass appropriate written orders forthwith.

8. With the above said directions this writ petition is disposed of.

9. Since this order is passed at 06:07 PM today and certified copies may not be immediately available to the petitioner to produce before the police tonight, the learned Government Advocate (Criminal Side) is directed to immediately communicate the operative portion of this order orally to Mr. Selvakumar, Inspector of Police, Thiruthangal Police Station, Virudhunagar District, to ensure strict compliance without awaiting a hard copy of this order. 16.09.2026 TM To
