JUDGMENT
(Judgment of the Court was delivered by P.Velmurugan J.) This Original Side Appeal is filed by the Federation of Motor Sports Clubs of India (FMSCI), challenging the order dated 25.02.2020 passed by the learned Single Judge in O.A.No.29 of 2020 in C.S.No.20 of 2020.
2. The first respondent, Joint Secretary of Coimbatore Auto Sports Club, filed the suit and the interlocutory application challenging the order dated 05.11.2019 passed by the FMSCI. By the said order, the FMSCI imposed a penalty of Rs.5,00,000/- and imposed restrictions on organising national championship events, including events outside Coimbatore till 31.12.2022.
3. The learned Single Judge found a prima facie violation of the principles of natural justice, as the first respondent was not given a reasonable opportunity to participate in the enquiry or the proceedings before the Council. The learned Single Judge also noted that no rules or regulations had been framed by the FMSCI for conducting such enquiry. Therefore, the learned Single Judge made the interim injunction absolute insofar as the ban on organising events outside Coimbatore was concerned. In respect of the penalty of Rs.5,00,000/-, the learned Single Judge recorded that the amount had been

paid without prejudice and observed that it was not necessary to interfere with the same, at that stage.
4. Challenging the said order, the FMSCI has filed the present Original Side Appeal.
5. The restriction on organising events outside Coimbatore was to operate till 31.12.2022. The said period has expired. Therefore, the restriction is no longer in operation and the interim relief granted by the learned Single Judge has become infructuous.
6. In view of the same, nothing survives for consideration in this appeal. Accordingly, the Original Side Appeal is dismissed as infructuous. The parties are at liberty to work out their remedies in the pending suit, in accordance with law. No costs. (P.V.,J.) (G.K.M.,J.) 15-09-2026 r n s
