Judgment

(Judgment of the Court was delivered by S.M.Subramaniam J.) The present writ appeal has been instituted by Union of India under Clause XV of the Letters Patent challenging the order dated 01.06.2023 made in W.P.No.8071 of 2012.

2. The facts in nut shell are that the first respondent was initially appointed under the Government of India and subsequently on formation of the Food Corporation of India (FCI), he exercised his option and consequently, transferred to Food Corporation of India. Thus, service conditions as applicable to the employees of Food Corporation of India were made applicable to the respondent. Under Section 12(A) of the FCI Act an opportunity was given to transferee employee like the respondent to opt for the scale of pay applicable to the post held by such employee under the Government immediately before the date of transfer or the scale of pay

applicable to the post under the Corporation to which the employee was transferred. The respondent also opted for terminal benefits admissible to the employees of the Central Government.

3. In the present case, the first respondent retired from service on 31.07.1992 on attaining the age of superannuation. He was a Central Government scale of pay optee and was receiving Central Government scale of pension from 1992 to 1999. In April 1999, the Central pension benefits were cancelled and revised pension was granted under the Food Corporation of India Act. The respondent filed W.P.No.9535 of 1999 and the said writ petition came to be allowed on 07.12.1999 by the learned single Judge. In pursuance to the directions issued in the writ petition, the competent authority rejected the claim of the respondent vide proceedings dated 17.08.2000.

4. Challenging the said rejection order, the first respondent filed W.P.No.17378 of 2000 and the said writ petition was dismissed on 27.11.2002. The first respondent filed writ appeal in W.A.No.124 of 2003, which was allowed by the Division Bench of this Court on 13.04.2010. The judgment of the Hon'ble Supreme Court in the case of Union of India and another -vs- P.N.Natarajan and Others (2010) 12 SCC 405 was delivered on 10.02.2010. That apart, the first respondent has initiated action parallelly

on cancellation of his central pensionary benefits. Thus, there is no delay in approaching the court and therefore, the benefits due to him from the date of his retirement cannot be denied in view of the judgment of the Supreme Court of India in the case sited supra.

5. Other issues raised by the first respondent are no more res integra. The Apex Court had already settled the issues in favour of the employees in Natarajan's case cited supra. This Court does not find any infirmity in respect of the writ order impugned in the present case. Consequently, the appellants are directed to settle the pensionary benefits, revised pension based on the subsequent pay commissions and all other consequential monetary benefits to the respondent within a period of three months from the date of receipt of a copy of this order.

6. With the above directions, the writ appeal stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.) (K.G.R.,J.) 15-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KST
