JUDGMENT
(Judgment of the Court was delivered by S.M.Subramaniam J.) The present writ appeal has been instituted challenging the writ order dated 10.07.2023 passed in W.P.No.29268 of 2022.
2. The present litigation is a 3rd round of litigation. Earlier the appellant filed W.P.No.16747 of 2020 raising similar grounds and this Court dismissed the writ petition on 03.02.2021. Appellant preferred W.P.No.1009 of 2022. He had withdrawn the writ petition with a liberty to approach the appropriate authority for appropriate relief. He submitted a representation on 30.04.2022 and the said representation was rejected. Again he filed W.P.No.29268 of 2022.
3. The Writ Court made a finding that the subject post of Village Assistant was earmarked for SC/ST women, particularly for destitute widow. The earlier litigation filed by the appellant reached finality on the ground that writ appeal was withdrawn. The representation submitted by him was also rejected.
WA No. 401 of 2024
4. Writ Court further made a finding that to fill up the said vacancy of Village Assistant, an advertisement also had been issued on 10.10.2022.
5. May that as it be, in any event, the petitioner cannot secure relief, since the earlier litigation reached finality and more so, appointment per se cannot be claimed as a vested right. All appointments are to be made strictly in accordance with Recruitment Rules in force.
6. In view of the above position, the writ appeal stands dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.) (K.G.R.,J.) 15-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No GD
