ORDER

The writ petition is filed seeking a direction to the third respondent to grant adequate police protection for the celebration of Thevar Jayanthi Festival, including Annadhanam and Mulappari festival from 30.10.2026 to 31.10.2026 in Namaskarittanpatti Village in Sivakasi Taluka without relaying the peace committee proceedings dated 10.09.2026 by considering the petitioner’s representation dated 22.10.2026 within the time stipulated by this Court.

2. The learned counsel appearing for the petitioner would submit that the petitioner has submitted a representation to the respondent police seeking permission and adequate police protection for the celebration of Thevar Jayanthi Festival, including Annadhanam and Mulappari festival from 30.10.2026 to 31.10.2026 in Namaskarittanpatti Village in Sivakasi Taluka. Since the said representation has not been considered so far, the petitioner has approached this Court.

WP Crl.(MD) No. 5881 of 2026

3. The learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that the request of the petitioner has been considered and permission was granted by the respondent police except for the procession through the disputed area. If the petitioner chooses an alternative route for the procession, the same would be considered by the respondent police.

4. This Court has considered the submissions made on either side and perused the materials available on record.

5. Considering the submission made by the learned Additional Public Prosecutor that the proposed procession through the disputed land is likely to give rise to law and order issues, the petitioner is directed to submit a fresh representation to the respondent police, indicating an alternative route for taking the Mulaipari procession. Upon receipt of such representation, the respondent police shall consider the same forthwith and pass appropriate orders in accordance with law.

6. With the above directions, this Writ Petition is disposed of. 28-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Rmk NOTE : Issue order copy on 28.10.2026
