ORDER

This writ petition has been filed seeking for a direction to the respondents particularly the 3rd respondent to consider the petitioner’s representation dated 23.09.2026 on merits and in accordance with law and subsequently pass orders in shifting the individual electricity wire connection from the petitioner’s house pathway in the lowest height to the higher height above the wind mill electricity wire connection on the same post forthwith.

2. The learned counsel appearing for the petitioner submitted that a high-voltage electric line passing through the petitioner’s residential property is causing severe inconvenience to the petitioner. In this regard, the petitioner has submitted a representation to the respondents seeking

WP(MD) No. 30525 of 2026 appropriate action. However, the said representation has not been considered so far, necessitating the filing of the present writ petition.

3. Heard the learned counsel on either side and carefully perused the materials placed before this Court.

4. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

5. In the light of the above observations and also the submissions made, there shall be a direction to the third respondent to consider the petitioner's representation dated 23.09.2026, on its own merits and pass appropriate orders in accordance with law, after affording opportunity of hearing to the petitioner and other concerned parties, within a period of four weeks from the date of receipt of a copy of this order. It is also

WP(MD) No. 30525 of 2026 made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

6. With the above direction, this writ petition is disposed of. No costs. 27-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SM
