ORDER

This writ petition has been filed seeking for a direction to the 1st respondent to direct the 4th and 5th respondents to remove their installation of an electricity pillar pole in the petitioner’s patta land comprised in Survey No. 291/13B, situated at Manjapettai Village, Gandarvakottai Taluk, Pudukkottai District, based on his representation dated 30.09.2026 in accordance with law. __________

WP(MD) No. 30598 of 2026

2. The learned counsel appearing for the petitioner submitted that the respondents 4 and 5 had erected an electricity pole on the petitioner’s patta land without obtaining the petitioner’s consent or permission and without his knowledge. In this regard, the petitioner submitted a representation dated 30.09.2026 to the first respondent, requesting appropriate directions to the respondents 4 and 5 to remove the said electricity pole. However, since no action has been taken on the said representation, the petitioner has approached this Court by filing the present writ petition.

3. Heard the learned counsel on either side and carefully perused the materials placed before this Court. Considering the limited scope of the relief sought for in this petition, notice to the respondents 4 and 5 is dispensed with.

4. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in __________

( Uploaded on: 28/10/2026 09:16:03 pm )

WP(MD) No. 30598 of 2026 invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

5. In the light of the above observations and also the submissions made, there shall be a direction to the first respondent to consider the petitioner's representation dated 30.09.2026, on its own merits and pass appropriate orders in accordance with law, after affording opportunity of hearing to the petitioner, the respondents 4 and 5 and other concerned parties, if any, within a period of four weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

6. With the above direction, this writ petition is disposed of. No costs. 27-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SM __________
