PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order in Ni.Mu.A4/4726/2017 dated 12.03.2018 on the file of the Respondent No.2 and quash the same as illegal and consequently for a direction to cancel the wrong sub-division and mutation made in T.S.No.6092/1 and restore the same in the name of the petitioner’s mother Mookkayi and one Solayammal as well as original patta holders within the time period stipulated by this Court.

ORDER
When the matter is taken up for hearing, the learned Counsel for the petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to challenge the impugned order before the appropriate authority. He has also made an endorsement to that effect. Permission is granted.

2. Recording the submission as well as the endorsement made by the learned Counsel for the petitioner, this Writ Petition is dismissed as withdrawn with liberty to the petitioner to challenge the impugned proceedings passed by the second respondent in Ni.Mu.A4/4726/2017 dated 12.03.2018 before the appropriate authority and while calculating the period of limitation, the period during which the appeal before the second respondent as well as the Writ Petition pending before this Court shall not be calculated.
