ORDER
The present Writ Petition has been filed in the nature of a Writ of Mandamus seeking for a direction to the fourth respondent to implement the order passed by the third respondent dated 28.01.2025 to cancel the patta No.1875 stands in the name of 5th respondent regarding survey No.13/4A1, which is situated at Pathinettankudi Village, Melur Taluk, Madurai District, based on petitioner’s representation dated 07.07.2026.
2. Heard Mr.S.Balaji, learned Counsel for the petitioner and Mr.S.Vashik Ali, learned Additional Government Pleader, who accepts notice on behalf of the respondents 1 to 4. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage. In view of the order proposed to be passed, notice to the fifth respondent is dispensed with.
3. A perusal of the order passed by the third respondent, dated 28.01.2025 would indicate that noting that there has been a violation of the assignment conditions in favour of one Kaveri, the third respondent directed the fourth respondent to initiate proceedings for cancellation of __________

WP(MD) No. 30292 of 2026 the assignment granted in favour of the said Kaveri.
4. Since proceedings have to be initiated for cancellation of the assignment for violation of its conditions, it is appropriate that notice would also have to be issued not only to the assignee but also to the subsequent purchaser, who has been impleaded as the 5th respondent in this Writ Petition. In that regard, this Court is of the view that the fourth respondent could be directed to initiate action as per the communication of the third respondent, dated 28.01.2025.

In such view of the matter, the Writ Petition stands disposed of with a direction to the fourth respondent to initiate appropriate action as per the communication of the third respondent, dated 28.01.2025 and pass appropriate orders on merits and in accordance with law after affording sufficient opportunity of hearing to all necessary parties concerned within a period of twelve weeks from the date of receipt of a copy of this order.
