respondent and quash the same and direct the 2nd respondent to allow the petitioners herein to procure fishing activities in the Panchapalli Chinnaru Dam along with other beneficiaries.”

2. The petitioners belong to the fishermen community and are the members of the 3rd respondent society. They submit that the fishing rights in the Panchapalli Chinnaru Dam had been granted to the 3rd respondent society, for a period of five years from 2020-2021 to 2024 – 2025, during which 60 members were permitted to carry out fishing activities.

3. The case of the petitioners is that the fishing rights were allotted to the 3rd respondent for a further period of five years from 26.08.2025 to 25.08.2030. However, the petitioners were denied permission to carry out fishing activities. Therefore, the petitioners submitted a representation dated 02.03.2026 seeking permission to participate in the fishing activity. However, the 2nd respondent vide order dated 14.07.2026, rejected the petitioners’ request on the ground that they had already benefited from fishing. Aggrieved thus, the petitioners are before this Court.

4. Heard the learned counsels on the either side and perused the records.

5. Admittedly, the 3rd respondent society which had been allotted fishing rights for a period of five years on preferential basis from 26.08.2025 to 25.08.2030. The grievance of the petitioners is that the rights are being allotted only to few of the members.

6. From the impugned order, it is clearly seen that 13 members have been selected in the general body meeting of the 3rd respondent and have also remitted necessary lease amounts to the 3rd respondent society. That apart, the petitioners had earned considerably in the earlier 5 year period. The impugned order would also indicate that the petitioners are also engaged in fishing through other societies.

7. Be that as it may, the petitioners are only members of the society and they cannot make claim independent of the society. By filing this writ petition, they are claiming a parallel right along with the 3rd respondent society. Therefore, the petitioners’ claim is totally unjustifiable.
