Order

This review application is filed to review the order dated 04.06.2026 passed in W.P.No. 18817 of 2026.

2. In WP.No.18817 of 2026, this Court had passed the following order: “6.The petitioner’s husband Senthil Kumar had been regularised into service of the 4th respondent on 28.05.1993. The said Senthil Kumar had died on 08.06.2021, leaving behind him his wife, daughters and son and the mother of the deceased. However, he was dismissed from service in the year 2019 under the provisions of Rule 17 (b) of the Tamil Nadu Civil Service (Discipline and Appeal) Rules. The petitioner’s husband has not challenged this dismissal till his death. He has also not claimed pension during his lifetime. The petitioner’s husband having been dismissed from service is not entitled to pension and consequently the relief claimed cannot be granted.

7. Accordingly, this writ petition is dismissed. No costs.”

REV.APLW No. 161 of 2026

3. It is now brought to the notice of this Court that the petitioner’s husband was not dismissed and was only suspended from service. It is also brought to the notice of this Court that the request for grant of family pension and death gratuity has been considered and also sanctioned by orders of the Office of the Accountant General (A&E), Chennai, dated 13.07.2026.

4. Therefore, paragraph Nos.6 and 7 of the order passed in WP.No.18817 of 2026 dated 04.06.2026 are amended to read as follows: “6. The petitioner’s husband was suspended from service in the year 2019, and a departmental enquiry was initiated against him. In the meantime, he passed away. Therefore, the petitioner is entitled to the family pension payable to her late husband.

7. Accordingly, this Writ Petition is allowed. No costs.”

5. This review application is allowed with the above modifications. Consequently, the connected miscellaneous petition is closed. No costs. 13-10-2026 KAN
