Order

This writ petition is filed for the following relief: “To call for the records relating to the order of the first respondent dated 25.09.2026 bearing No.5085/DCRY/D3/Residence/2026-27 confirming the order passed by the second respondent in No.REV/2026/05583 dated 10.09.2026 and quash the same and to direct the respondents to issue residence certificate to the petitioner.”

2. The petitioner is aggrieved by the rejection of her request for grant of residence certificate by the 2nd respondent which is confirmed by the 1st respondent.

3. The petitioner’s grievance is that despite producing documents to show that she is a resident of Yanam, the respondents 1 and 2 have mechanically

rejected her application. A reading of the two orders would also confirm the grievance of the petitioner. The 2nd respondent has passed an order rejecting her request on a one line order which reads as follows: “The applicant is married to person in Uttar Pradesh during 2021. Hence not recommended.”

4. The order passed by the 1st respondent is also on the same lines. The 1st respondent stated that the order in appeal was passed based on the order of the 2nd respondent, as well as the documentary evidence produced before the 2nd respondent, which was found wanting.

5. Though the 1st respondent stated that he has perused documentary evidence, the order does not spell out the documents that had been perused by him. Further, as already submitted the 2nd respondent’s order is a non speaking one and I am at loss to understand how the 1st respondent concluded that the 2nd respondent had applied his mind.”

6. Therefore, in the above circumstances, the impugned orders cannot sustained. Accordingly, this writ petition is allowed. The order of the 1st respondent and the order passed by the 2nd respondent are quashed. Consequently, the matter is remitted back to the 2nd respondent for considering the application afresh. The 2nd respondent shall permit the petitioner to submit

additional documents hear her and pass speaking orders, within a period of 2 weeks from the date of receipt of a copy of this order. Consequently, the connected miscellaneous petitions are closed. No costs. 13-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KAN
