COMMON ORDER

Heard Mr.V.C.Janarthanam, representing for Mr.S.Balakrishnan, counsel for the petitioner and Mr.Prakash Goklaney, learned counsel for the respondent/decree

( Uploaded on: 21/09/2026 06:45:11 pm )

CRP Nos. 4892 and 4896 of 2026 holder.

2. After hearing the learned counsel for the petitioner and the learned counsel for the respondent, I find that the Trial Court has found from the records that summons have been served privately and affidavit of service has also been filed by producing the original acknowledgment card. Therefore, I am unable to accept the arguments advanced on the side of the petitioner that there has been no proper service of summons in the suit before the petitioner was set exparte. Consequently the argument that the application was filed within 492 days from the date of knowledge is not acceptable.

3. However, considering the age of the respondent/decree holder and also the fact that the petitioner has already made a deposit of Rs.10,00,000/-(Rupees Ten Lakhs only) in compliance with the conditional order passed by this Court, I suggested to the parties to reach a one time settlement.

4. Mr.Prakash Goklaney, learned counsel for the respondent/decree holder, on instructions, submitted that his client is willing to give a quietus, provided the petitioner pays further sum of Rs.15,00,000/-(Rupees Fifteen Lakhs Only) in addition to Rs.10,00,000/-(Rupees Ten Lakhs Only) already deposited.

5. However, learned counsel for the petitioner, on instructions, came forward with a counter proposal that he would pay an additional sum of Rs.10,00,000/-(Rupees Ten Lakhs Only) in full quits, provided reasonable time is granted for such payment.

6. Learned counsel for the respondent, on instructions from the respondent, who is also present in court, has agreed to the said offer.

7. In the light of the above, while confirming the impugned order, both the civil revision petitions are disposed of in the following manner:-

(i) The respondent shall record full satisfaction of the decree in his favour, for a sum of Rs.20,00,000/-(Rupees Twenty Lakhs Only);

(ii) A sum of Rs.10,00,000/-(Rupees Ten Lakhs Only) having been already deposited shall be paid out to the respondent/decree holder, at the earliest, by the Executing Court on a formal application being filed in this regard, which
