ORDER

The petitioner is the decree holder, who has filed E.P.No.71 of 2020 for taking possession, pursuant to final decree passed on 17.02.2020. The Hon’ble Supreme Court, as well as this Court have time and again reiterated that execution petition has to be disposed of expeditiously and not later than six months. Admittedly, in the present case despite lapse of 6 years since the final decree was passed, the petitioner has been unable to enjoy the fruits of the final decree, by not being able to take possession of the properties allotted to him under the said final decree.

2. In the light of the limited prayer sought for in the revision petition, I am inclined to dispense with notice to the respondent.

3. It is also brought to my notice by the learned counsel for the petitioner that already two Section 47 applications have been filed to protract the proceedings and they have been dismissed. However, by setting up another third party, yet another application has been filed under Section 47 CPC. In view of the above, the Executing Court shall dispose of all pending miscellaneous applications, including any Section 47 application pending, within a period of four weeks and thereafter, dispose of the EP finally within a period of eight weeks thereafter.
