JUDGMENT

(Judgment of the Court was delivered by P.Velmurugan J.) When the matter is taken up for hearing, the learned counsel appearing for the appellant would submit that the dispute between the parties has been amicably settled and that pursuant to the said settlement, a memo dated 10.09.2026 to that effect has also been filed before this Court. He would further submit that in view of the settlement arrived at between the parties, the appellant does not intend to prosecute the present appeal and therefore, seeks permission of this Court to withdraw the appeal. The learned counsel has also made an endorsement to that effect.

2. This Court has carefully considered the submissions made by the learned counsel appearing for the appellant and has also perused the memo showing the settlement arrived between the parties and the endorsement made by him.

3. In view of the settlement arrived at between the parties, this appeal is dismissed as withdrawn as settled out of Court. The terms of settlement arrived at between the parties shall form part of the decree. (P.V.,J.) (G.K.M.,J.) 10-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No VKR
