JUDGMENT
(Judgment of the Court was delivered by P.Velmurugan J.) This appeal is preferred as against the order passed by the learned Single Judge dated 16.09.2025 in Arb.O.P.(Comm.Div.) No.448 of 2025.
2. When the matter is taken up today the learned counsel for the appellants filed a memo stating that the third appellant died on 11.03.2026 and therefore, the first appellant partnership has been reconstituted. Hence, he seeks permission of this Court to withdraw this appeal.
3. Per contra, the learned counsel for the respondents objected to the withdrawal, contending that the appeal itself is not maintainable, as the order under challenge was passed under Section 11 of the Arbitration and Conciliation Act and an appeal against such an order is barred under Section 37 of the Arbitration and Conciliation Act. He further submitted that the appellants have been harassing the respondents by making them run from pillar to post

through various legal proceedings and that they have now simply filed the present application. Hence, he prayed that heavy costs may be imposed.
4. It is the contention of the learned counsel for the respondents that the appeal itself is not maintainable under Section 37 of the Arbitration and Conciliation Act. However, the learned counsel for the appellants seek permission of this Court to withdraw the appeal.
