JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) The present intra-court appeal has been instituted challenging the writ order dated 26.09.2023 passed in WP.No. 31992 of 2012.

2. Writ appellant herein is the petitioner. He participated in the

WA No. 3588 of 2023

process of selection notified in the year 2012 for appointment of Group-II Common Degree Post.

3. Petitioner claims that he is eligible to be considered under the category of BC-OTM-Tamil Medium. He admittedly secured 228 marks. However, the counter affidavit filed by the Tamil Nadu Public Service Commission would show that the appellant, Thiru B. Babu, had failed to enclose evidence for having studied the prescribed qualification in Tamil Medium along with his application for posts included in CSSE-I 2009- 2011. Hence, he was not considered under the PSTM category.

4. Submitting documents at a later point of time will not be considered by the Tamil Nadu Public Service Commission. However, the case of the appellant was considered under the category of B.C. (G) (PSTM), for which the cut-off mark is 231. Since the appellant had scored 228 marks, he was not selected under the category of B.C. (G) (PSTM).The claim of the appellant to consider his name under BC-OTM- Tamil Medium was rejected, on the ground that he had not produced any evidence at the time when the application was submitted. That apart, the process of selection was conducted in the year 2012, and the appellant does not fall within the zone of consideration. In respect of his claim, he has not enclosed his evidence at the time of submission of the

application.

5. That being the factum, there is no infirmity in the order passed by the Writ Court in the impugned order dated 26.09.2023 passed in WP.No. 31992 of 2012 and the same is confirmed. Accordingly, the writ appeal is dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.)
