JUDGMENT
(JUDGMENT OF THE COURT WAS MADE BY DR.G.JAYACHANDRAN,J.) The Management, being aggrieved by the order of the Special Deputy Commissioner of Labour, rejecting the application filed for approval of dismissal, has preferred Writ Petition No.14587 of 2017, challenging the order passed by the first respondent in Approval Petition No.134 of 2013, dated 16.03.2015. The learned Single Judge, on considering the delay in filing the approval petition, dismissed the writ petition on 25.11.2022. Aggrieved by the said order, the Management has filed the present appeal with an inordinate delay of 1055 days.
2. The reason stated for the belated filing of the appeal is the demise of the learned counsel, who was instructed to file the appeal. Though the said reason may be justifiable, if the delay is reasonable, it cannot justify condoning the delay of three years, particularly, when the appellant is an organisation under the Government and does not depend upon one individual. Hence, the petition seeking condonation of delay stands dismissed. Consequently, this Writ Appeal is rejected at the SR stage itself. No order as to costs. (Dr.G.JAYACHANDRAN,J.)
