ORAL ORDER

By this O.A., the applicants are seeking the following relief: “....may be pleased the records about the correspondence between the 1st respondent and other official respondents and vice versa in the matter of extending the benefits of the order dated 20.07.2017 of the Hon'ble High Court of Kerala in O.P (CAT). Nos.213/2017 and 271/2016 to other similarly placed non-petitioners for up- grading the Senior Chargeman to the pay scale of Rs.5500-9000 w.e.f.01.01.1996; and declare the inaction in the matter of extending the said benefit to the Applicants as illegal, unjust and consequently direct the respondents to fix the pay of the Applicants in the pay scale of Rs.5500-9000 in 5th CPC w.e.f. 01.01.1996 in the post of Senior Chargeman and accordingly pay the arears pertaining to the difference in pay between the pay already drawn in the pay scale of Rs.5000-8000 and the pay scale of Rs.5500- 9000 by granting all other consequential benefits which accrue from time to time and pass such other relief or reliefs as this honourable Tribunal may deem fit just and necessary in the circumstances of the case.”

2. Highlighting the facts of the case, Mr. P B Vijay Kumar, ld. Sr. Counsel appearing for the applicant submits that the applicants, as on 01.01.1996, were working as Senior Chargemen, and vide the V CPC, Pay Scale of ₹5500-175-9000 was recommended for the Sr.Chargemen of Naval Armament Supply Organisation and Pay Scale of ₹5000- 150-8000 was recommended for similarly placed Sr. Chargemen. The Sr. Chargemen of Naval Dockyard, Visakhapatnam, Mumbai & Naval Ship Repair Yard, Cochi, filed O.A.s seeking pay scale of ₹5000-175-9000, which were dismissed by the Coordinate Bench, Ernakulam, but the case was allowed by the Hon’ble High Court of Kerala in OP(CAT) 271/2016 & OP(CAT) 213/2017. Subsequently, the Coordinate Bench, Mumbai, also allowed O.A./514/2015 & this Tribunal, vide order, dt.01.04.2021, allowed O.A./124/2020, involving similar issue. Despite various representations, the IHQ of MoD (Navy) implemented the order, dt. 20.07.2017, only in personam in respect of the applicants in the various O.A.s filed seeking pay parity, and not to the applicants herein. Hence, the O.A.

3. When the matter is taken up for hearing, it is highlighted by the learned counsel for the Respondents, at the outset, that the applicants’ representations are pending, which can be disposed of by the competent authority.

In view of the submission, we are of the considered view that the matter can be disposed of by directing the Respondents to consider, examine and dispose of the applicants’ representations, annexed as Ann A-I to the O.A., within a period of two months of the date of receipt of the order. In the event it is found that the applicants are similarly situated to the applicants in OP(CAT) 271/2016 & OP(CAT) 213/2017, which came to be allowed, vide order, dt.20.07.2017, of the Hon’ble High Court of Kerala, let appropriate, reasoned and speaking orders be passed by the competent authority in respect of the applicants herein, in light of the above-mentioned order, following the principles of natural justice. If there is a distinction to be made out, the same may be clearly spelled out in the order passed while disposing of the applicants’ representations.

5. The O.A. is disposed of in the aforesaid terms. All pending Miscellaneous applications stand closed. Interim relief granted, if any, stands vacated. No order as to costs.
