ORAL ORDER
(As per Hon’ble Mr. Manish Garg, Judicial Member)
The applicant, a Sub-Postmaster (Group-C), was granted the 2nd financial upgradation under the MACP scheme w.e.f. 08.02.2016 and opted under FR 22(I)(a)(1) for pay fixation from 01.07.2016, the date of next increment, thereby coming over to the 7th CPC pay structure from that date. The Internal Audit objected that this violated Rule 5 of the CCS (RP) Rules, 2016, and directed recovery of Rs.1,80,186/- by revising his pay w.e.f. 01.01.2016. Aggrieved, the applicant filed the present O.A.
2. The Additional Reply filed by the respondents states that after the Finance Ministry’s letter dated 04.07.2023, the applicant re-exercised his option on 12.07.2023, his pay was refixed from 08.02.2016; and arrears of Rs. 1,00,706/- were paid to him in May 2026. Counsel for the applicant conceded that the recovered amounts have been refunded to him.
3. In view of the above, the O.A. is dismissed as infructuous. Pending MAs, if any, stand disposed of. No order as to costs.
