COMMON ORDER

Heard Mr.K.Thilageswaran, learned counsel for the revision petitioners, allottees in all the revision petitions, and Mr.T.Gowthaman, learned Additional Advocate General, appearing for the respondents.

The grievance of the revision petitioners is that despite the award specifically mentioning that the claimants had conceded to the inclusion of Rs.1,75,000/- towards land cost without interest being charged on the said amount, and the arbitrator also passing a definite award with directions at Paragraph 30 of the award dated 25.09.2021, the respondents have gone by a unilateral and arbitrary calculation at their whims and fancies. For non- compliance of the said final cost demand made by the respondent board, the Executing Court has now dismissed the execution petition. I find force in the said submission of the learned counsel for the revision petitioners.

3. Mr.T.Gowthaman, learned Additional Advocate General, appearing for the respondents, would state that, out of 840 plots, excepting 64 allottees, all other allottees have paid the final cost as demanded by the board and sale deeds have already been executed.

The apprehension of the learned Additional Advocate General is that if any orders in favor of the claimants are passed, interpreting the award, then it may open the Pandora’s box, with the allottees who have already been issued sale deeds coming up before the Court, seeking a refund of alleged excess amounts paid.

It is brought to my notice that, out of the 64 revision petitioners, 15 allottees have paid the final cost as demanded by the board pending CRPs, and sale deeds have already been executed in their favor. Such of these petitioners will also lose their right to claim any alleged refund of excess amounts paid towards final costs.

It is made clear that the order passed in these revision petitions is limited only to the rights of the revision petitioners, excepting those who have voluntarily paid the final cost as determined by the Respondent Board and obtained sale deeds in their favor, and not to the other allottees in respect of whom the final cost has been determined, paid, and satisfied, and sale deeds have already been executed, which includes some of the allottees/revision petitioners who have paid the amount, pending these revision petitions.

7. The remaining allottees shall be heard before the Executing Court for the exercise to be undertaken, as set out herein below.

8. In view of the above, the impugned orders in these revision petitions are set aside, and the E.Ps are restored to file.

9. The Execution Court shall go into the issue of the demand of final costs made by the Respondent Board and see whether it is in tune with the directions issued by the Arbitrator in the award dated 25.09.2021.

10. It is open to both parties to put forth their respective claims and objections with regard to any further amounts due and payable or not by the allottees. The same shall be finally determined, strictly in line with the directions issued by the arbitrator, since the said award is put to execution and admittedly the award has attained finality.

11. Depending on the enquiry to be conducted by the Executing Court, and if the Executing Court finds that any further amounts are due and payable by the petitioners, the Executing Court shall direct payment of the said amounts to the respondent board, upon which the respondent board shall execute sale deeds in favor of the revision petitioners.
