ORDER
Heard Mr.N.K.Sivakumar, learned counsel for the revision petitioners/claimants and Mr.P.Sunil. learned Government Advocate for the respondent.
2. The grievance of the petitioners is that the executing Court viz., the Subordinate Court, Poonamallee has returned the execution petition filed by the claimant as petitioner/decree holder with a direction to transmit the award and institute the execution petition before the City Civil Court, Chennai.
3. I find from the impugned order dated 12.02.2025 that pendency of WP No.24664 of 2021 has also been referred to. It is now brought to my notice by the learned counsel for the petitioners that subsequently on 07.03.2025, this Court disposed of WP No.24664 of 2021 directing the amount to be deposited before the Subordinate Court, Poonamalee.
CRP No. 5487 of 2026
4. Mr.P.Sunil, learned Government Advocate appearing for the respondent also affirms the said statement and in fact, states that the amount was deposited before the Subordinate Court, Poonamalee on 05.08.2026 which is evidenced by official communication in Na.Ka.No.3368/1987 dated 10.08.2026.
5. In the light of the above, when the amount has been deposited only before the Subordinate Court, Poonamallee, the petitioners were well within their right to approach the Subordinate Court, Poonamallee for recovery of the amount due and payable. Now that the amount has already been deposited, the executing Court shall facilitate payment out of the said amount in terms of the direction issued by this Court in WP No.24664 of 2021 dated 07.03.2025.
6. Learned counsel for the respondent also fairly states that in view of the order passed in WP No.24664 of 2021 , the respondent has no objection for the amount being paid out to the petitioners in the execution petition as well.
7. In the light of the above, the impugned order dated 12.02.2025 made in EP No.51 of 2017 in LAOP No.543 of 1987 is set aside and the executing Court is directed to process payment out of the amount deposited, lying to the credit of LAOP No.543 of
CRP No. 5487 of 2026 P.B.BALAJI.,J sr 1987, in favour of the revision petitioners within a period of four weeks from the date of receipt of a copy of this order.
8. With the above direction, the civil revision petition is allowed. No costs. 09.09.2026 sr Index:yes/no Website:yes/no Speaking Order/Non-speaking Order To The Subordinate Court, Poonamallee CRP No. 5487 of 2026
