ORDER

The petitioner has filed this revision petition seeking to strike off the E.P. No.2052 of 2025, pending before the XXVIII Assistant Judge, City Civil Court at Chennai. The said Execution Petition has been filed pursuant to an award passed in favour of the respondent/decree holder in award dated 26.04.2017.

2. According to the revision petitioner, she has been arrayed as the third judgment debtor in the said Execution Petition. The grievance of the revision petitioner is that she has not been served with notice in the ARC proceedings and she came to know about the award only after attachment of salary was effected. According to the learned counsel for the petitioner, the fraud has been played by the decree holder and the petitioner, not being a signatory to any of the Chit transaction, has been erroneously included as a guarantor and her signature has been forged and behind her back, an award has been passed which was also put to execution and an exparte order for attachment of her salary has also been obtained.

3. Admittedly, the Execution Petition has been filed pursuant to the award passed in ARC No.1075 of 2016, besides the revision petitioner there are four other judgment debtors. Therefore, even on this sole ground, this Court cannot exercise jurisdiction under Article 227 of the Constitution of India to strike off the Execution Petition. If at all according to the revision petitioner, she was never a party to the chit transaction or the ARC proceedings and that the attachment order was passed behind her back, it is always open to the petitioner to move the Executing Court by taking out an appropriate application for raising the order of attachment of salary. If any such application is filed, the same can be considered and disposed of on merits within a period of four weeks.

4. This Civil Revision Petition is dismissed with the above liberty. Consequently, connected Miscellaneous Petition is also dismissed. No costs. 09.09.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP To The XXVIII Assistant Judge, City Civil Court at Chennai.
