ORDER
(Order of the Court was made by S.M.Subramaniam J.) The learned Senior Counsel appearing on behalf of the review petitioners would mainly contend that as per the order of this Court sought to be reviewed, persons already promoted shall not be reverted, but the seniority shall be altered. He would further contend that for the purpose of recruitment to the post of Sub Inspector of Police, the ratio is maintained at 60:40. If promotions were given over and above 40, there will be more number of seniors in the cadre of Sub Inspector of Police and in that event, the right of the review petitioners considered for further promotion to the post of Inspector of Police would be ruined.
2. Pertinently, writ petitions had been instituted in the year 2022 and writ appeals were filed and disposed of by this Court by way of a detailed order. The said ground, if entertained, it requires further adjudication on merits. Re-adjudication of merits or re-appreciation of findings made in the order would not constitute a ground to entertain a review petition. The scope of Order 47 Rule 1 of CPC cannot be expanded. Grounds for appeal cannot be considered in a review proceeding. All other grounds raised in the review petition relating to merits need not be adjudicated by this Court.
REV.APLW No. 147 of 2026
3. Since the petitioners have not established any error apparent on the face of the record, the present review petition is dismissed. No costs. (S.M.S.,J.) (N.S.,J.) 09-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SLI To
