ORDER

This petition has been filed for issuance of Writ of Mandamus, directing the 2nd and 3rd respondents to adhere the order passed by the 1st respondent in Na.Ka. No. Aa2/90/2023 dt. 10.01.2023 by considering the petitioners representation dt. 14.08.2026 within the time frame as fixed by this Court.

2. Mr.D.Rajaboopathy, learned Government Advocate, (Crl. Side) takes notice for the 3rd respondent and Mr.A.Sivasubramanian, learned Additional Government Pleader takes notice for the respondents 1 and 2. Heard the counsel on either side and perused the records.

3. The petitioner, a resident of Valinokkam, Kadaladi Taluk, Ramanathapuram District, has filed the present petition seeking a direction to respondents 2 and 3 to adhere to the order passed by the first respondent in Na.Ka.No.A2/90/2023, dated 10.01.2023, which is stated to be a peace committee resolution. According to the petitioner, one of the parties to the said resolution is causing obstruction in respect of the temple property and is attempting to form a layout by relying upon a forged patta and is also attempting to fence the temple property. In this regard, the petitioner submitted a representation dated 14.08.2026 to respondents 2 and 3. Alleging that no effective action has been taken on the said representation, the petitioner has approached this Court by way of the present petition.

4. The learned Additional Government Pleader submitted that, though the petitioner has filed the present writ petition based on the peace committee resolution dated 10.01.2023 convened by the first respondent, there has been a subsequent development in the said village. Pursuant to the order passed by this Court in W.P.(MD)No.20558 of 2021, dated 04.08.2022, the second respondent convened a peace committee meeting. In the said meeting, a resolution dated 08.09.2025 was passed by the second respondent.

5. The learned Additional Government Pleader further submitted that, in the said proceedings, the 'A' party had obtained an order from this Court in the above writ petition for measurement of the subject temple properties. The proceedings of the peace committee reveal that the subject property is temple property and that the petitioner was one among the 'B' party in the said peace committee meeting conducted by the second respondent.

6. It is further submitted that the resolution dated 08.09.2025 is a subsequent development and that, in the said resolution, the following decision was taken: @nfhtpy; eph;thf m jug;gpdh; nfhtpy; epyj;jpy; Rw;Wr;Rth; vLj;J mog;gil trjp bra;J bfhs;s brd;id cah;ePjpkd;w kJiuf; fpisapy; cj;jut[ bgw;Ws;sjhf bjhptpj;Jdh;/ nkw;go ePjpkd;w cj;jutpd; mog;gilapy; khtl;l Ml;rpah; mth;fSf;F ghpe;Jiu bra;tJ

7. A perusal of the minutes of the said peace committee meeting reveals that the Revenue Authorities should not issue patta in the name of any individual or trustee in respect of the subject property, as the property is temple property. It was further resolved that, if any person has any grievance in respect of the same, the affected party may approach the competent Court of law seeking appropriate legal remedy. It was also resolved that any law and order issue arising in this regard would be dealt with by the Police Department in accordance with law.

8. The learned Additional Government Pleader submitted that, since the second peace committee meeting was conducted in the year 2025 and the resolution dated 08.09.2025 was a subsequent development, the same may not have been brought to the notice of the learned counsel at the time of filing the present petition. Upon receipt of the said resolution, the learned counsel for the petitioner submitted that the present writ petition may be disposed of by recording the subsequent peace committee resolution dated 08.09.2025.

9. In view of the above subsequent development and recording the resolution dated 08.09.2025 passed by the second respondent, no further direction is required in the present writ petition.

10. Accordingly, this Writ Petition is disposed of. 09.09.2026 TM To

1. The Sub Collector/sub Divisional Magistrate, Office of the Sub Collector, Paramakudi, Ramanathapuram District.

2. The Tahsildar, Office of the Tahsildar, Kadaladi, Ramanathapuram District.

3. The Inspector of Police, Sikkal Police Station, Sikkal, Ramanathapuram District.

4. The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai.
