CENTRAL ADMINISTRATIVE TRIBUNAL BANGALORE Order Sheet Item no.: 6 O.A./252/2026 (BANGALORE) [ TRANSFER ] Court No.: 2 No of Adjournment: 9 Order Dated: 26/10/2026 CHANDRAKALA S BHAT Vs DEPTT OF ELECTRONICS INFORMATION TECHNOLOGY

For Applicant(s) Advocate : Ms. M L Suvarna For Respondent(s) Advocate : Shri S. Prakash Shetty Order of The Tribunal Ms. M L Suvarna on behalf of the applicant. Shri S. Prakash Shetty on behalf of the respondents. Arguments commenced but not concluded. The learned counsel for the applicant, in support of her relief sought for, has invited my attention to Clause (2) and Clause (8) of the Transfer Policy which is circulated vide Circular No. F. No. 2(1)/2019-Pers./3108906 dated 19.09.2025. She has also placed reliance on the following Judgments:

(i) Judgment of CAT, Bangalore Bench vide OA No. 274/2026 dated 21.08.2026

(ii) Judgment of Hon'ble High Court of Allahabad vide Writ A No. 8161/2022 dated 05.12.2022 She has furnished the above judgments across the Bar. Per contra, the learned counsel for the respondents has submitted that the transfer is an incident of service and has also relied upon transfer guidelines at Annexure-I. However, this Annexure-I appears to be part of some other document and is lacking in mandatory details like subject matter, reference number, date of issue and the designation/name of Issuing Authority.

In view of the above, the counsel for the respondents has agreed to furnish the following:

(i) Complete copy of the document including Guidelines at Annexure R-1.

(ii) The list of employees who have also been transferred out in pursuance to these Guidelines and who have completed 25 years of service within a State, including those who were left with less than 2 years of service. List the case again for final arguments on 03.11.2026. Interim Order granted earlier stands extended till the next date of hearing.
