CENTRAL ADMINISTRATIVE TRIBUNAL JODHPUR Order Sheet Item no.: 25 O.A./262/2026 (JODHPUR) [ TRANSFER/POSTING ] Court No.: 1 No of Adjournment: 2 Order Dated: 26/10/2026 GAURAV KATIYAR Vs CENTRAL GROUND WATER BOARD

For Applicant(s) Advocate : Mr. Mahendra Singh Godara, Advocate, present for the applicant For Respondent(s) Advocate : Mr. K.S.Yadav, ACGSC, presaent for the respondents - CGWB Order of The Tribunal The present O.A. has been filed challenging the impugned order dated 09.10.2026 (Annex.A/1), passed by the respondents in compliance of the directions issued by this Bench in the earlier round of litigation i.e. in O.A. No. 227/2026 decided on 09.09.2026.

2. The facts of the case in brief are as under : The applicant, STA(M), was transferred from Division–XI , CGWB, Jodhpur to CHQ, Faridabad vide Office Order No. 275/2026 dated 17.06.2026 (Annex.A/2). The applicant, thereafter, was promoted as Assistant Engineer vide Office Order No. 302 dated 03.07.2026. Vide representation dated 17.06.2026 (Annex.A/5), the applicant by citing family circumstances alternatively prayed to retain him at Jodhpur up to 31.03.2027. Thereafter, he was posted at CGWB, Division-XI, Jodhpur with his retention up to 31.08.2026 with a direction to join his duties at Faridabad immediately thereafter. In this regard, vide Corrigendum dated 17.07.2026 (Annex.A/4), it was clarified that the earlier transfer order was made applicable on his promotion to the post of Assistant Engineer.

3. Being aggrieved with the transfer order, the applicant in the first round of litigation filed OA No. 227/2026 before this Bench with a prayer to keep the transfer order dated 17.06.2026 and the relieving order dated 07.09.2026 qua him, in abeyance. After hearing counsel for the parties, this Tribunal directed the respondents to consider and decide the prayer made by him by passing a speaking order and, till such a decision on his representation is taken, the effect and operation of the transfer order dated 17.06.2026, qua the applicant, was stayed.

4. In compliance of the order passed by this Tribunal, vide impugned order dated 09.10.2026 (Annex.A/1), the request for cancellation of the transfer/further retention of the applicant at Jodhpur up to 31.03.2027, has not been acceded to, and, he has been directed to report for duties at CGWB, CHQ, Faridabad within one week from the date of receipt of this order. In the impugned speaking order, the respondents clarified that in his subsequent representation dated 29.06.2026 (Annex.A/13), he had specifically made alternate request for his retention at CGWB Division-XI, Jodhpur, as Assistant Engineer only up to 31.08.2026 for completion of the ongoing projects and proposals to PIB Project of Rajasthan State with a categorical statement that he would not seek further extension beyond 31.08.2026.

5. After considering the personal grounds raised by the applicant and keeping in view the administrative exigencies and the undertaking dated 29.06.2026 given by the applicant, the respondents observing that no sufficient ground exists for cancellation of transfer order and for his further retention at Jodhpur beyond 31.08.2026. With the above observation the representation filed by the applicant was rejected.

6. Upon perusal of the impugned order, we find no justification to interfere with the above order. The request of the applicant to retain him for some more period considering the on-going projects, has already been considered and the applicant was granted extension for a reasonable time up to 31.08.2026. In the subsequent representation dated 29.06.2026 (Annex.A/13), the applicant himself prayed to retain him at Jodhpur up to 31.08.2026 for completion of the ongoing projects and proposals pertaining to PIB

of Rajasthan State with the statement that he will not ask for any further extension. The applicant has already retained at Jodhpur up to 15th of October, 2026.

7. In view of the above, we find no justification in allowing him to continue at Jodhpur till 31.03.2027. The impugned speaking order is just and fair. Resultantly, the O.A. is dismissed at admission stage with no order as to costs. HUKUM SINGH MEENA Member (A) Rameshwar Vyas Member (J) Jitendra Mehta ( pps )
