O R D E R
(Order of the Court was made by D.Bharatha Chakravarthy,J.) This Review Application has been filed to review the order dated 05.08.2022 made in W.P.No.20473 of 2022.
2. Learned counsel for Review Applicant would submit that a complaint had been given by the Review Applicant that nature of properties is at large and the same is under consideration by Appropriate Committee. However, having regard to the facts and circumstances of the case, imposition of cost of Rs.10,000/- is causing undue hardship to the Review Applicant.
3. We have considered the said submission made by learned counsel for Review Applicant.
4. On perusal of the order dated 05.08.2022, which is sought to be reviewed, it may be seen that Civil Court passed a Decree in O.S.No.11053 of 2009 on 20.04.2015 and considering the said decree, the order was passed. Therefore, no ground is made out to reverse the said findings. Further, Competent Authority can always consider the said decree on merits.
5. Considering the overall facts and circumstances of the case and the plea raised by the learned counsel for Review Applicant, we partly allow the Review Application with the observation as stated supra and remove the costs of Rs.10,000/-.
