1. Through the medium of the instant O.A., the applicant seeks the following reliefs:
1. Quashing the impugned University Order No. 22-Est of 2026 dated 06-04-2026 appointing the private respondent before issuance of the provisional selection list along with Office Order No. 842 of 2026 dated 07.08.2026 and communication dated 15-09-2026 treating the post as a fresh vacancy together with all consequential actions being arbitrary, illegal and unconstitutional and direct the respondents to explain how the appointment preceded the selection list.
2. Direct the respondents to treat the post of Assistant Finance Officer as an unfilled vacancy and operate the waiting list by appointing the applicant who stands at Serial No. 1 against the post of Assistant Finance Officer in the Islamic University of Science and Technology Awantipora Pulwama with all consequential benefits.
3. Any other order, writ or direction may also be issued in favour of the applicant and against the respondents which this Hon'ble Tribunal deems fit and necessary in the facts and circumstances of the case.
4. Direct the respondents to restrain from Re advertising the post of Assistant Finance Officer

Learned counsel for the applicant, Mr. Shaqir Rajab, submits that an appointment order was issued in favour of the private respondent vide University Order No. 22-Est of 2026 dated 06.04.2026, whereby the private respondent was appointed as Assistant Finance Officer. He submits that for the same post of Assistant Finance Officer, the provisional selection list was issued on 21.04.2026, that is after the issuance of the appointment order of the private respondent no. 4. Mr. Rajab, further submits that the situation is like putting the cart before the horse.
3. Prima facie, what appears from the annexures on file is appointment order's date is of 06.04.2026 and the provisional list and waiting list is dated 21.04.2026.

5. Issue notice upon the respondents. Mr. Syed Musaib, learned DAG, appears and accepts notice for the official respondents no. 1 to 3, who will file his detailed response. As regards, private respondent no. 4, Mr. Rajab shall submit one AD cover along with one set of O.A. for service upon the private respondent within two days before the Registry of this Court. On needful being done, registry of this Court shall serve the private respondent in accordance with law.
6. In the peculiar facts and circumstances of the case, it has become expedient to direct Mr. Syed Musaib, learned DAG, to produce the record pertaining to the selection of the Assistant Finance Officer before this Court in a sealed cover, in addition to filing of his response.
7. Any further orders shall be subject to objections of the respondents.
