1. Heard on M.A. No. 1372/2026 seeking restoration of O.A. No. 380/2026.
2. Learned counsel for the applicant submits that O.A. No. 380/2026 was dismissed in default on 08.09.2026 due to non-appearance and seeks restoration of the Original Application to its original number and file. It is submitted that the absence was neither intentional nor deliberate.
3. Conversely, learned counsel for the respondents opposes the M.A. on the ground that the reasons stated therein do not constitute sufficient cause for restoration and, accordingly, prays for its dismissal.
4. Having considered the grounds urged in the M.A. and the submissions made by learned counsel for the parties, this Tribunal is of the view that, in the interest of justice, the applicant should be afforded an opportunity to have the matter adjudicated on its merits rather than being denied such an opportunity on technical grounds.
5. Accordingly, M.A. No. 1372/2026 is allowed, and O.A. No. 380/2026 is restored to its original number and file. The connected M.As., if any, shall also stand restored, subject to the terms of the order dated 08.09.2026.
6. Learned counsel for the applicant is directed to correct the numbering of the respondents on page 5 of the Original Application and submit the corrected copy before the Registry on or before the next date of hearing.
7. Pleadings in the Original Application are complete.
