1. The short facts of the case are that the applicants earlier filed an O.A./1127/2026 which was disposed of by this Tribunal directing the respondents to treat the aforesaid O.A. as a representation and decide the case of the applicants by passing a speaking order. In compliance, an Order No. 141-DSWK of 2026 dated 17.10.2026 has been passed by the respondents, whereby the representation/claim of the applicants has been decided by directing that the applicants shall continue to operate in accordance with the earlier impugned order dated 07.10.2026. The applicants are aggrieved of the impugned order dated 17.10.2026 and have challenged the same on the grounds as urged in the O.A.
2. Heard.
3. Issue notice upon the respondents. Mr. Furkan Yaqub Sofi, learned GA, appears and accepts notice for the respondents, who is granted two weeks' time to file his reply.
4. Learned counsel for the applicant, Mr. Attar, submits that the Director, Social Welfare Kashmir, has no power in law to have issued either an Order dated 07.10.2026 or the order impugned as the applicants belong to the UT Cadre post.
5. Mr. Furkan, learned GA, shall file his reply along with a short affidavit as regards the submission of learned counsel for the applicant, as to whether the Director, Social Welfare Kashmir, has the power to issue the order impugned or the earlier order dated 07.10.2026. The needful shall be done within a period of one week.
6. In view of the peculiar facts and circumstances of the case, when challenge is thrown to the competence of the authority who has passed the order and till the affidavit as regards the competence is filed, I deem it expedient and in the interest of justice and in order to preserve the subject matter of the lis to direct status quo be maintained as on date till Wednesday, i.e., 28.10.2026.
7. Mr. Furkan, learned GA, shall ensure filing of the short affidavit as regards the competence.
8. Alteration/modification on motion.
9. List this matter as case no. 1 on 28.10.2026.
