(Judgment of the Court was made by S.M.Subramaniam, J.) The present intra-court appeal under Clause 15 of the Letters Patent has been instituted by the writ petitioners, who instituted the writ petition seeking absorption in Chennai Petroleum Corporation Limited.

2. The lands belonged to the appellants were acquired for developing Chennai Petroleum Corporation Limited. It is not in dispute

W.A.NO.462 OF 2024

that the Government acquired lands and settled compensation under the Land Acquisition Laws to the owners. Since there was a demand to provide employment to the land-losers, initially, employment was provided to them in the Industrial Co-operative Service Society, a registered Society under the Co-operative Societies Act. These land- losers were accommodated in the Society in the year 1988 and served there for a considerable length of time, and have either retired or are on the verge of retirement.

3. The learned counsel for the appellants would mainly contend that some of the land-losers were absorbed in Chennai Petroleum Corporation Limited. Therefore, similar benefits have to be extended to the appellants also.

4. For the lands acquired, compensation has already been settled. Any additional benefit extended to the land-losers is only a concession and cannot be claimed as a vested right. In order to accommodate the land-losers, the Scheme was formulated. In the present case, the learned counsel for the first respondent would submit that the cases of these appellants were considered by the Corporation

W.A.NO.462 OF 2024

and that the Corporation found them unsuitable for appointment to any post in the Petroleum Corporation. Therefore, they were accommodated as employees in the Co-operative Service Society, where they have already served for long years.

5. This Court is of the considered view that employment to a land-loser is an additional concession granted by the Government or the requisitioning body, subject to the suitability of the candidate and the availability of posts in the Corporation. In the present case, the appellants were permitted to serve as employees of the Industrial Co-operative Service Society. In view of the same, they are not entitled to seek any further relief of permanent absorption from this Court. Thus, the writ order impugned cannot be construed as infirm. Consequently, the writ appeal is dismissed. No costs. [S.M.S., J.] [K.G.R., J.]
