ORDER
This Civil Revision Petition has been filed to set aside the order dated 12.03.2025 passed in M.P.No.05 of 2025 in M.C.O.P.No.1234 of 2011 on the file of the IV Court of Small Causes, Chennai (Motor Accident Claims Tribunal).
2. The revision petitioner challenges the order dated 12.03.2025 directing the revenue recovery proceedings to be initiated against the revision petitioner. It appears that the impugned order which is challenged in the revision is only a Form-24 under Section 69(2) of the Revenue Recovery proceedings for issuance of a recovery certificate to the tune of Rs.42,08,580/- as against the revision petitioner. Admittedly, the revision petitioner appears to have not been put on notice and heard before the said order came to be passed. I also do not find any speaking order preceding the issuance of the said Form-24 on 12.03.2025.
3. In light of the above, I am inclined to set aside the order dated 12.03.2025 passed in M.P.No.05 of 2025 in MCOP No.1234 of 2011 and remit the matter to the learned IV Court of Small Causes, Chennai. The Tribunal shall hear the petitioner as well as the insurer and thereafter decide the application on merits within a period of four weeks from the date of receipt of a copy of this order.
CRP No. 4619 of 2026
4. With the above direction, this Civil Revision Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 03-09-2026 NSL To
