J U D G M E N T

(Judgment of the Court was made by S.M.Subramaniam, J.) The present writ appeal has been instituted by the Commissioner, Salem City Municipal Corporation, Salem, challenging the writ order dated 23.01.2023 passed in W.P.No.1030 of 2023.

2. The respondent is a retired employee of Salem Corporation. There was a delay in settling the terminal benefits. The respondent claimed interest for the delayed settlement of terminal benefits.

3. The learned counsel for the appellant would submit that the award of 10% interest per annum to the delayed settlement of terminal benefits are excess and it will lead a wrong precedent.

4. As far as Corporations are concerned, they are also following the Tamil Nadu Pension Rules, 1978. Rule 45-A of the Tamil Nadu Pension Rules, 1978 speaks about the ‘interest on delayed payment of gratuity’. Sub-rule (1)(b) stipulates “ten per cent per annum beyond a period of one year”.

W.A.NO.150 OF 2024

5. In the present case, the delay was calculated as 16 months. That being the factum, there is no infirmity in respect of the writ order impugned. Consequently, the writ appeal stands dismissed. No costs. Consequently, connected civil miscellaneous petition is closed. [S.M.S., J.] [K.G.R., J.]
