Order
The present miscellaneous petition has been instituted to grant leave to the petitioner / third party to file a petition to recall the order dated 26.04.2023 made in W.P.No.5346 of 2014.
2. This Court elaborately considered the issues in a batch of writ petitions and issued multiple directions to the authorities to protect the temple properties in accordance with the provisions of the Statutes and Rules in force. Pursuant to the orders of this Court, the competent authorities had initiated action and an extent of 122.81 Acres were resumed by the authorities. The possession was taken over and now the property vests with the temple and it is being used for the benefit of the temple.
3. Under these circumstances, the present application is filed to grant leave to file a petition to recall the order dated 26.04.2023. First of all, the said order has already been implemented and the properties belonging to the temple are restored by the competent authority, and possession had been taken over. Secondly, the suit filed by the petitioner in O.S.No.15 of 2001 on the file of the Principal Subordinate Judge, Chengalpattu was dismissed for non-prosecution on 12.01.2004. The survey number in the suit schedule indicate that the said property is the part and parcel of the temple property, which has already been dealt with by the competent authorities.
4. Learned Senior Counsel Mr.R.Singaravelan appearing for the second respondent would bring to the notice of this Court that
Mr.K.K.Ananthapadmanabhan, Advocate who is the hereditary trustee of Arulmighu Sundareswaraswamy Temple, Kovur, filed a complaint before the Deputy Commissioner of Police, Ambattur, Chennai to initiate action on the complaint dated 26.08.2026. However, no action has been taken.
5. The Deputy Commissioner of Police, Ambattur shall look into the complaint and initiate appropriate action either by himself or through the jurisdictional police, as the case may be, and by following the procedures as contemplated under law.
6. As far as the present petition to recall the order of this Court dated 26.04.2023 is concerned, the same is unnecessary since the said order has already been implemented by the competent authorities and the properties belonging to the temple have already been restored. The suit filed by the petitioner also was dismissed in the year 2004. That being the factum, the present petition seeking to grant leave to file a petition to recall the order dated 26.04.2023 made in W.P.No.5346 of 2014 stands dismissed. 03-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KST
