ORDER

(Order of the Court was made by S.M.Subramaniam J.) The present writ petition has been instituted challenging the order of punishment of withdrawal of 25% of monthly pension for a period of two years.

2. Admittedly, petitioner has not preferred the statutory appeal contemplated under the Service Rules. The appeal would lie before the Registrar General, High Court of Madras. Exhausting the appellate remedy is of paramount importance. The appellate authority is empowered to deal with the appeal based on the original documents and evidences available on record. Thus, findings of the appellate authority in the appellate order would be of greater assistance for the purpose of exercise of powers of judicial review by the High Court. That apart, the petitioner also will get an opportunity to raise all the grounds based on the evidences and documents available. Right of appeal is a valuable right conferred on an employee under the Service Rules.

3. In the present case, since the petitioner has not exhausted the appellate remedy, this Court is inclined to relegate the petitioner to approach the competent appellate authority against which the order of penalty imposed

by the Principal District Judge, Cuddalore, in proceedings dated 28.08.2025 and 29.08.2025.

4. In view of the above facts, the petitioner is at liberty to prefer a statutory appeal before the appellate authority. On receipt of any appeal, the appellate authority shall take the appeal on file without reference to the delay in filing an appeal and decide the same on merits and in accordance with law as expeditiously as possible.

5. With the above directions, the writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.) (K.G.R.,J.) 03-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No GD To
