(Judgment of the Court was delivered by S.M.Subramaniam,J.) HVF English Medium Educational Society is the appellant before this Court, challenging the Writ Order dated 19.06.2023 passed in W.P.No.32633 of 2022.

2. One R.Thirunavukarasu / 1st respondent herein had filed Writ of Mandamus, seeking direction against all the respondents to treat his service as regular service till 31.01.2025 and pay the benefits.

3. Admittedly, 1st respondent was appointed by HVF English Medium Educational Society, which is a Society, running a school, namely, Vijayanta Senior Secondary School. It is a private Management. 1st respondent was receiving salary from Management. His appointment has not been made either by Government nor approved by Government.

Till the date of his retirement, he continued as Management employee. In respect of employees serving in Private Management, they have to approach competent Forum for redressal of their grievances. Since Vijayanta Senior Secondary School is a private school and is not a State within the meaning of Article 12 of Constitution of India, 1st respondent has to approach the competent Forum for the purpose of securing appropriate relief.

4. Thus, granting liberty to the 1st respondent to approach the competent Forum, the present Writ Appeal is allowed. The impugned order of Writ Court dated 19.06.2023 passed in W.P.No.32633 of 2022 is set aside. No costs. Consequently, connected Miscellaneous Petitions are closed. (S.M.S.,J.)
