ORDER

Heard learned counsel for the petitioner Mr.M.M.Karunanantham and Mr.Hasan Mohamed Jinnah, learned Senior Counsel for Mr.S.Udayakumar, learned counsel for the respondents 1 and 2. This order shall be read in conjunction and part and parcel of the earlier order dated 19.08.2026. The petitioner is also present in person before this Court.

2. Pursuant to the order dated 19.08.2026, the revision petitioner/tenant today has filed an affidavit of undertaking that he would peacefully vacate and handover vacant possession of the tenanted premises (two shop portions) that is under his occupation, on or before, 31.01.2027. The said copy of the undertaking is also served on the learned counsel for the respondents.

3. Though Mr.Hasan Mohamed Jinnah, Senior Counsel for Mr.S.Udayakumar for R1 & R2 appearing for the respondents/landlords states that the petitioner is liable to pay double the rent, since he has not vacated the tenanted premises, despite efflux of the time, as originally contemplated under the rent agreement, admittedly, the respondents had only preferred an eviction petition alleging default in payment of rents. It is also brought to my notice that the petitioner has been set exparte and it is posted for further proceedings before the Rent Court.

4. In the light of the above, I am not inclined to invoke Section 23 of the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017, considering that as on date, there is no eviction order passed and it is only the petitioner who has voluntarily undertaken to vacate and hand over vacant possession. However, it is needless to state that the petitioner would continue to pay the present monthly rent of Rs.11,770/- without any default, till such time, he vacates and hand over vacant possession, not later than

31.01.2027.

5. Accordingly, this Civil Revision Petition is partly allowed, setting aside the order of the Rent Authority fixing fair rent, however, recording the affidavit of undertaking filed by the petitioner, that he would vacate and hand over vacant possession by 31.01.2027, subject to prompt payment of rents of Rs.11,770/- every month, which shall be paid on the 10th of the same month in advance (Example: the rent for September, 2026, shall be paid on or before September 10, 2026, and so on and so forth), the petitioner shall vacate and handover vacant possession, on or before, 31.01.2027. In the event of any default being committed by the petitioner in either payment of monthly rents as undertaken herein above in the undertaking affidavit or, not vacating, on or before 31.01.2027, it shall be open to the respondents shall initiate contempt proceedings. No costs. Consequently, connected Miscellaneous Petition is also closed. 31.08.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP To
