ORDER

Though the revision petition is at the instance of the petitioner-landlord, having lost before the Rent Court as well as the Rent Tribunal, pending the revision, the respondent-tenant has come forward to undertake to vacate and hand over vacant possession of the tenanted premises, provided one year time is granted to the respondent to vacate and hand over vacant possession.

2. The tenant in this regard has filed an affidavit of undertaking, besides also undertaking to pay rents at Rs.5,000/- per month + applicable GST from 01.09.2026 onwards. The respondent has also stated that he would pay the rents promptly, without any default and also applicable GST, subject to the petitioner-landlord raising necessary invoices in time. It is admitted on both sides that as on date, there are no arrears of rent payable by the respondent. The respondent has also stated that the original advance of Rs.901/-, which still lies with the petitioner, has to be refunded, across the respondent vacating and handing over vacant possession.

3. In the light of the above and recording the affidavit of undertaking, the Civil Revision Petition is allowed and the order of the Rent Court in RLTOP.No.314 of 2023 dated 20.02.2024, on the file of the XII Small Causes Court, Chennai, and confirmed in appeal by the XIX Additional City Civil Court, Chennai, dated 15.09.2025 in RLTA.No.104 of 2024 are set aside. The respondent is entitled to deduct a sum of Rs.901/- from the last month rent payable in August 2027, which shall be paid on or before 10th of August 2027.

Insofar as the other months, the respondent-tenant shall pay the rents on or before 10th of the succeeding month i.e rent for September 2026 shall be paid on or before 10th October 2026 and so on.
