ORDER

Heard Mr.P.Sunil, learned counsel for the petitioner in the contempt who is

CONT P No. 2477 of 2026 the landlord and Ms.Samyuktha, learned counsel for the respondent/tenant.

2. The petitioner filed eviction proceedings against the respondent herein which came to be disposed of by this Court in CRP No.3632 of 2025 by order dated 10.11.2025, the respondent was given time till 31.01.2026 to vacate and hand over vacant possession and also clear the arrears of Rs.9,08,000/- as on that date.

3. Admittedly, today, the respondent has vacated and handed over vacant possession though not as undertaken on or before 31.01.2026.

4. Mr.Sunil, learned counsel for the petitioner/landlord brings to my notice that the arrears payable is Rs.12,00,000/-(Rupees Twelve Lakhs only).

5. Today, including GST and three months rental arrears represents Rs.10,62,000/-(Rupees Ten Lakhs Sixty Two Thousand only) which is admitted by the respondent/tenant. He, however, states that the respondent suffered huge losses in business and since he has already vacated, he is not in a position to pay the arrears as committed before this Court in the revision petition. The respondent has also issued three post dated cheques for Rs.3,54,000/-(Rupees Three Lakhs Fifty Four thousand only) each, commencing from November 2026 and ending January, 2027. Today,

CONT P No. 2477 of 2026 cheques have been handed over to the petitioner/landlord.

6. It is made clear that the three said cheques shall be honoured on presentation and if there is even one instance of default, it is open to the petitioner to revive the contempt and this Court will take serious note of any such violation. With the above observation, the contempt petition is closed. 27.08.2026 sr
