Mishra Order of The Tribunal MA No.1359/2026 has been filed by the applicants for appropriate direction. Counsel for the applicants submits that despite the interim direction by this Tribunal, the respondents have issued the circular dated 03.10.2026 (Annexure MA-2), wherein they have issued the list of persons directing them to exercise the option form before or on 15.10.2026, failing which, they shall be permanently absorbed in the DPSU's. The applicants' name also figures in this list. Counsel for the respondents submits that the last date of filling option was 15.10.2026 and most of the candidates have already exercised their options for permanent absorption in newly created DPSUs. Therefore, he seeks modification of the interim order. He further submits that on a similar issue, the Principal Bench of this Tribunal has disposed OA No.1218/2026.

In view of such position, we modify our interim order to the extent that any decision taken in pursuance of the options exercised by the applicants shall be subject to outcome of this Original Application. MA No.1359/2026 is accordingly disposed of. Counsel for the applicants seeks time to file rejoinder. Time is granted. List this matter for consideration on 03.12.2026.
