1. On the case being taken up for hearing, Shri Rajesh Sharma, Ld. Counsel for the applicants-Union of India & Ors and Shri Kishore Rai, Ld. Counsel for the respondent are present. R.A No. 40 of 2026
2. This review application has been filed by applicants-Union of India & Ors against execution application No. 346 of 2023 inre O.A. No. 138 of 2022. By means of this review application, learned counsel for the applicants-Union of India & Ors submits that the respondent-applicant was discharged from service on 30.06.2004, and prior to discharge from service, he was granted last increment on 19.06.2003 and his next increment fell due on 01.06.2004. It is further submitted that since the applicant was discharged from service on 30.06.2004, his next increment due on 01.06.2004 would have been granted to the respondent-applicant prior to his date of discharge.
3. Learned counsel for the applicants-Union of India & Ors further submits that due to typographical error in the counter affidavit filed in O.A. No. 138 of 2022, the said facts could not be mentioned in counter affidavit. He pleaded for allowing the review application.
4. On the other hand, learned counsel for the respondent-applicant submits that the statement made on behalf of the applicants-Union of India is misconceived as the applicant-respondent was discharged from service with basic pay of Rs 4,019/- whereas in response to RTI dated 07.07.2022, the applicants-Union of India & Ors have stated that basic pay of the applicant- respondent was Rs 2,387/- as on 01.07.2004.
5. Heard learned counsel for the both the parties and perused the record.
6. We find that the applicant-respondents was granted MACP on 01.06.2004 prior to discharge from service, therefore, he was not entitled for grant of notional increment which was due on 01.07.2004. In this regard the submission made on behalf the applicants-Union of India & Ors being trustworthy, this review application is allowed. Order dated 07.09.2022 passed by this Tribunal in O.A. No. 138 of 2022 is recalled as the applicant was not eligible for grant of notional increment due on 01.07.2004.

1. On the case being taken up for hearing Shri Kishore Kumar, Ld. Counsel for the applicant and Shri Rajesh Sharma, Ld. Counsel for the respondents are present. M.A No. 342 of 2024 & 343 of 2024
2. Ld. Counsel for the respondents has already filed objection on restoration application as well as on delay condonation application.
3. Heard the ld. Counsel for the parties and perused the records.
4. The applicant has filed restoration application for recall of order dated 09.09.2013 passed by this Tribunal in TA No. 102/2012 by which the TA was dismissed for non prosecution. Applicant has also filed delay condonation application.
5. There is delay of 10 years 05 months and 03 days in filing the restoration application. Ld. Counsel for the applicant submitted that when no information about the status of the case was intimated to the applicant he requested the present counsel to get the status of the case. On enquire from the Registry the applicant’s counsel came to know about the dismissal of his case. Thereafter the present counsel has got the certified copy of the order and filed the restoration application. Applicant’s counsel urged that delay in filing the restoration application should be condoned as there is no wilful or deliberate attempt to avoid the court proceedings on part of the applicant.
6. Per contra, learned counsel for the Opposite Parties vehemently opposed the delay condonation application and submitted that the applicant has not shown plausible reasons for condoning the delay. The grounds mentioned in the delay condonation application do not justify the delay. The
applicant should remain vigilant for his rights. Applicant has not explained the reasons for inordinate delay of more than 10 years in filing the restoration application.
7. Considered the submissions of the learned counsel for the parties and perused the records.
8. Perusal of the record reveals that the TA was dismissed on 09.09.2013 for non prosecution and since then the applicant has not approached this Tribunal for a long time.
9. Of course a liberal view should be taken, but the applicant has miserably failed to show any solid ground for approaching the Tribunal with inordinate delay of more than 10 years. The applicant has been negligent in preferring the restoration application. Restoration application has been moved after more than 10 years for which sufficient explanation has not been put forth. Applicant has slept over his rights.
10. In a case reported in Balwant Singh (Dead) vs. Jagdish Singh & others (2010) 8 Supreme Court Cases 685), the Hon’ble Supreme Court while considering the grant of condonation of delay held in paragraphs 26 as under : -
“26. The law of limitation is a substantive law and has definite consequences on the right and obligation of a party to arise. These principles should be adhered to and applied appropriately depending on the facts and circumstances of a given case. Once a valuation right has accrued in favour of one party as a result of the failure of the other party to explain the delay by showing sufficient cause and its own conduct, it will be unreasonable to take away that right on the mere asking of the applicant, particularly when the delay is directly a result of negligence, default or inaction of that party. Justice must be done to both parties equally. Then alone the ends of justice can be achieved. If a party has been thoroughly negligent in implementing its rights and remedies, it will be equally unfair to deprive the other party of a valuable right that has accrued to it in law as a result of his acting vigilantly.
11. In view of the law settled by the Hon’ble Supreme Court and keeping in view the factual position of the present case, the applicant has miserably failed to show the sufficient cause for condonation of delay in filing the Restoration Application.
12. The law on the point of delay condonation is that doctrine of delay and laches should not be lightly brushed aside. A Court is not expected to give indulgence to such indolent persons who compete with Kumbhakarna or for that matter Rip Van Winkle.
13. Applying the aforesaid principles to the present case, it is evident that the applicant has filed restoration application after more than 10 years for which sufficient explanation has not been given.
14. Delay condonation application lacks merits and is liable to be dismissed.
15. Accordingly, delay condonation application is dismissed.
16. Consequently, the Restoration application is also dismissed.
