2. Supplementary counter affidavit filed by the respondents is taken on record.

3. Heard the ld. counsel for the parties and perused the records.

4. This original application has been filed by the applicant for grant of disability pension to the applicant from the date of his retirement.

5. Ld. Counsel for the applicant submits that the applicant was enrolled in the Army as Sepoy on 29.11.1985 and after serving for more than 26 years of service he retired on completion of terms of engagement in the rank of Havildar on 30.11.2011 after having being low medical category Shape-P2 (permanent) with 30% disability for Primary Hypertension for life and 20% disability for Glucose Tolerance & Obesity for life and over all disability was quantified at 50% for life. The applicant submitted his claim for granting his disability pension which has been rejected by the respondents vide letter dated 30.03.2012 being held both the disabilities as NANA. Thereafter, the applicant preferred his first appeal dated 10.08.2020 which too has also been rejected by the respondents.

6. Ld. Counsel for the respondents has filed counter affidavit and submitted that the instant original application has been filed by the applicant in the year 2023 before this Bench but prior filing of this O.A, the applicant has already filed an another O.A No. 1710 of 2020 for same cause of action / same relief before the Principal Bench of this Tribunal at New Delhi.

7. Ld. Counsel for the respondents further submitted that as per law, the same applicant cannot file two separate O.As for same relief/ same cause of action. The applicant has suppressed the fact of filing the previous O.A. Hence, this O.A is not maintainable and is violation of Sec 10 of CPC and this O.A is liable to- be dismissed.

8. Heard the ld. Counsel for the parties and perused the records.

9. Ld. Counsel for the respondents has filed supplementary counter affidavit alongwith the copy of the original application filed by the applicant before the Principal Bench of this Tribunal.

10. Perusal of the file reveals that the applicant has sought the same relief as requested in the instant O.A before us. The applicant has sought quashment of impugned order dated 10.08.2020 and grant of disability pension in both the O.As.

11. As per section 10 of the CPC, no Court shall proceed with the trial of any suit in which the matter in issue is also directly and substantially in issue in a previously instituted suit between the same parties, or between parties under whom they or any of them claim litigating under the same title where such suit is pending in the same or any other Court in India having jurisdiction to grant the relief claimed, or in any Court beyond the limits of India established or continued by the Central Government and having like jurisdiction, or before the Supreme Court.

12. In view of above, we are of the considered view that in the present case, it is crystal clear from pleadings that matter in issue in both OAs is directly and substantially identical. Therefore, this is a fit case to invoke section 10 of the CPC as the applicant has filed both the O.As with same cause of action.

13. The applicant has preferred O.A No. 1710 of 2020 before the Principal Bench of this Tribunal at New Delhi for same cause of action / same relief as sought in the present O.A. The matter is barred by Res Sub- Judicata.

14. Accordingly, the instant O.A is dismissed.

15. Misc. Application(s), if any, pending for disposal, shall be treated to have been disposed of.
