3. The applicant Dil Prasad Gurung has filed this application through Jaman Singh Gurung. As per annexures A-4, A-5 and A-6, Dil Prasad Gurung is disabled person and Jaman Singh Gurung has been shown as patronage. Contrary to that according to Annexure A-3, Jaman Singh Gurung himself is suffering from disability and he is in the guardianship of Asha Gurung. A question arises as to whether a person who is incompetent and he himself is under guardianship of the another person can be guardian of another disabled person.

4. Thus, we find certificates at Annexure A-3 and Annexure A-4 are contrary to each other. In such a situation, when Jaman Singh Gurung is already suffering from disability and is under guardianship of Asha Gurung, he cannot act as guardian of another disabled person being himself disabled.

5. Ld. Counsel for the applicant is directed to explain the above situation and do the needful by the next date of listing.

3. Today, this case was listed to explain the anomaly as mentioned in order dated 29.07.2026 and no guardianship has been filed by the learned counsel for the applicant.

4. We are of the considered view that disabled person could not be guardian of a disabled person and this O.A. is not maintainable.

5. Accordingly, O.A. is dismissed as not maintainable. However, liberty is granted to the learned counsel for applicant to approach the Tribunal when guardianship of a non-disabled person is obtained in favour of the applicant from the appropriate forum.
