ORDER

The applicant retired on 31.12.2022 on reaching the age of superannuation. He was in a Permanent Low Medical Category on account of disability of ‘Bilateral Sensorineural Hearing Loss’, the extent of which was assessed to be 20% for life and aggravated by military service. However, claim for grant of disability element was rejected by the competent authority by stating that eligibility conditions were not fulfilled. Learned counsel for the applicant has relied upon the judgment of the Hon’ble Supreme Court in CA No.164 of 1993 Ex-Sapper Mohinder Singh Vs Union of India and others, decided on 14.01.1993, to submit that the competent authority had no jurisdiction to reject the claim by returning a finding which was not in consonance with the finding of the Medical Board.

Notice.

Mr. JS Lalli, DSGI, accepts notice on behalf of the respondents and waives service and seeks time to file reply. Adjourned to 09.04.2027.
